Vinh Long Court ruling on divorce case involving Lieu Cam An, Chrissy Minh Chau Nguyen

(VOVWORLD) - On September 12, 2017, the Vinh Long provincial People’s Court held a trial in the divorce case between Mr. Lieu Cam An as the petitioner and Mrs. Chrissy Minh Chau Nguyen (Nguyen Minh Chau) as the respondent.

Mrs. Chrissy Minh Chau Nguyen (Nguyen Minh Chau), born in 1974, resides at 329 Dadeville St, Se, Palm Bay, FL 32909, the USA and Mr. Lieu Cam An, born in 1976, resides at 15, Pho Co Dieu Road, Ward 8, Vinh Long city, Vinh Long province, Vietnam. 

Mr. An told the court that he and Mrs. Chrissy Minh Chau Nguyen registered for marriage at Vinh Long provincial People’s Committee on May 27, 2008. After their marriage, they lived in Vietnam for three weeks. Then, Mrs. Chrissy Minh Chau Nguyen returned to the USA and has not come back to Vietnam. Since 2010, the couple has not kept in contact. Mr. An said the purpose of their marriage was not achieved and asked the Court to terminate their marriage. Mr. An said he and Mrs. Chrissy Minh Chau Nguyen had neither children nor shared property. The prosecutor agreed that the petitioner complied with all existing legal procedures. According to the Vietnamese Embassy in the US, the judicial entrustment did not take place because the respondent’s address was not correct or she no longer stayed at that address. The petitioner failed to provide the court with a new address of the respondent. Though several notices had been made via the mass media (VOVWORLD), Mrs. Chrissy Minh Chau Nguyen made no response. Therefore, the Court’s trial in the absence of the respondent is legal in accordance with Clause 6 of Article 477 of the Civil Procedure Code. The Court noted that their children and shared property, if any, shall be settled in a separate case if requested by the parties involved. Mr. An will bear all related fees under the law.

Pursuant to Articles 469 and 479 of the Civil Procedure Code; Articles 51,19, 56, 123, 127 of the Law on Marriage and Family; Article 27 of the Ordinance on Court Costs and Fees (No.326/2016/UBTVQH dated December 30, 2016) of the National Assembly Standing Committee; it is ordered and decreed by the Court that Mrs. Chrissy Minh Chau Nguyen, the petitioner, and Mr. Lieu Cam An, the respondent, are divorced and that the marriage between them is dissolved.

Mr. Lieu Cam An paid the court fee and the overseas judicial entrustment cost.

Mr. Lieu Cam An has the right to file an appeal against the Court’s ruling within 15 days after the decree is announced. The duration for Mrs. Chrissy Minh Chau Nguyen to file an appeal against the Court’s ruling is 01 month since the decree is announced.
