Can Tho Court’s ruling on the case involving Tran My Linh, Tran Chan Phat, Tran My Anh,Tran Chan Dat

(VOVWORLD) - The Can Tho provincial People’s Court would like to inform Tran My Linh, born in 1948; Tran Chan Phat, born in 1950; Tran My Anh, born in 1952; and Tran Chan Dat, born in 1954; of its first-instance ruling (No. 08/2017/DS-ST) dated August 28, 2017.

Pursuant to Articles 26, 37, 152, 153, 227, 479 of the 2015 Civil Procedure Code; Articles 101, 102, 212 of the 2015 Civil Code; the 2009 Law on mutual legal assistance; Article 3 of the 2013 Land Law; the 2009 Ordinance on court costs and fees; Resolution No. 326/2016/UBTVQH14, dated December 30, 2016, of the Standing Committee of the National Assembly; Resolution No. 01/2012/NQ-HĐTP, dated June 30, 2016, of the Judges Council of the Supreme People's Court; Joint Cicular No. 15/2011/TTLT-BTP-BNG-TANDTC, dated September 15, 2011, of the Ministry of Justice, Ministry of Foreign Affairs, and the Supreme People's Court; Circular 18/2014/TT-BTC, dated February 11, 2014, of the Ministry of Finance.

The court does not accept the lawsuit filed by the plaintiff, Ms. Tran Thi Cac, demanding Mr. Tran Chan Buu divide the property inherited from Ms. Vo Huynh Hoa into 9 parts, in which Ms. Cac receives 1 part, estimated at 200,000,000 VND.

First instance legal fee: Ms. Tran Thi Cac is not required to pay the first instance legal fee. The court fee advance of 5,000,000 VND she made on May 22, 2013 at the Can Tho provincial Department of Civil Judgment Enforcement (Receipt No. 000514) will be refunded.

Overseas judicial entrustment fee: Ms. Tran Thi Cac has to pay the overseas judicial entrustment fee of 2,100,000 VND. The payment was deducted from the court fee advances she made on April 6, 2015 (Receipt No. 0000795), on March 2016 (Receipt No. 0000422), on October 21, 2016 (Receipt No. 0000978, 0000979, 0000980, 0000981, 0000982, 0000983, and 0000984) at the Can Tho provincial Department of Civil Judgment Enforcement (Receipt No. 001026). Ms. Cac has fully paid the first instance legal fee.

          Postage fee:  Ms. Cac has to pay 582,000 VND of postage fee. The full payment has been made.

Ms. Tran Thi Cac, Mr. Tran Chan Thanh, and the Vietnam Bank for Agriculture and Rural Development have the right to file an appeal against the Court’s ruling within 15 days after the decree is announced. The duration for Mr. Tran Chan Phuoc and Mr. Tran Chan Buu to file an appeal against the Court’s ruling is 15 days after the decree is announced. Ms. Tran My Linh, Ms. Tran My Anh, Mr. Tran Chan Dat, Mr. Tran Chan Loc, Mr. Tran Chan Phat have the right to file an appeal against the Court’s ruling at the high-level People’s Court in Ho Chi Minh City within 30 days after the decree is announced.
