Corruption prevention and control: important elements in building a law-governed state

(VOVWORLD) - November 9 is observed as Vietnam Law Day to honor the important role of law in state governance, especially in building and perfecting a socialist state governed by law in Vietnam. Laws against corruption are indispensable to realizing the goal of building a law-governed state.

President Ho Chi Minh said embezzlement, waste, and bureaucracy delayed the national resistance war and construction.

The Communist Party of Vietnam believes that preventing and combating corruption plays an important role in national reform. Fighting corruption and negativity protects the Party and the law-governed socialist state of Vietnam, builds a more valid, fair, and efficient Government, and contributes to stronger economic development and better performance of social functions.

Building a legal system to prevent and fight corruption

Anti-corruptionlaws have been a focus since the establishment of the Democratic Republic of Vietnam, now the Socialist Republic of Vietnam.

During national construction and development, guidelines and policies have been designed to prevent and fight corruption. The 3rd plenum of the 10th Party Central Committee in 2006 issued a Resolution on strengthening the Party's leadership in preventing and fighting corruption and waste.

Before that the 2005 Law on Anti-Corruption specified ways to control the assets and income of people in positions of power. It marked a change in awareness of the need to control the assets and income of officials, civil servants, and managers who exercise public power over people.

With careful steps in corruption prevention and control associated with political stability and socio-economic development, the 13th National Party Congress in 2021 inherited and developed guidelines and continued to prevent and repel corruption and waste with stronger political determination and more effective actions.

In November 2022, the 13th Party Central Committee issued Resolution No. 27 on continuing to build and perfect the law-governed socialist state of Vietnam in the new period. The Resolution clearly identified 10 groups of tasks and solutions, including enhancing anti-corruption and anti-negativityefforts by forming strict prevention mechanisms.

The amendment of the Law on Anti-Corruption in 2007 and 2012 created a comprehensive corruption prevention mechanism. Most recently, the National Assembly passed the revised Law on Anti-Corruption in 2018. It demonstrated Vietnam's political determination to fight corruption, with the motto "No holds barred".

Improving the effectiveness of the Law on Anti-Corruption 

As an important factor in building a law-governed socialist state, the Law on Anti-Corruption has been steadily improved to align with Vietnam's institutions and legal system. Legal documents have been fine-tuned to control assets and income, recover corrupted assets, effect administrative reforms, and apply technology to management and non-cash payments.

Vietnam is implementing the National Strategy on Preventing and Combating Corruption until 2030, focusing on reviewing and amending legal loopholes related to socio-economic management, anti-corruption, and anti-negativity. Specific tasks will be proposed to the National Assembly’s law and ordinance program, concentrating on the capacity to prevent, detect, and handle corruption and negativity.

Combating corruption and negativity aims not only to clean up the apparatus and protect the Party, the law-governed socialist state, and the health of social relations, but also to promote Vietnam’s socio-economy. Building a law-governed socialist state of Vietnam is an urgent requirement of international integration. Fine-tuning the Law on Anti-Corruption will play an important role in realizing these goals.
