Promoting democracy in constitutionalization

(VOVworld) – The first phase of collecting public opinions on the draft revisions of the 1992 Constitution according to National Assembly Resolution 38 concluded on March 31 with positive results. During the referendum, publicity and democracy have been promoted through a number of innovative measures in order to build a quality Constitution.

Publicity and democracy are demonstrated by the distribution of the draft Constitution to a broad range of people. Never before has the Constitution been widely and densely mentioned on mass media and in social forums. People in urban and rural areas, in remote, mountainous, isolated places, and ethnic minority groups know about this political drive to different extents. Meetings and seminars to collect public opinions were held from central to local levels. Copies of the draft Constitution were given to every household. Pham Khac Dung who lives in Tan Binh ward, Ho Chi Minh city, says: "We have received sufficient information on Constitution revision through the mass media. The ward’s People’s Committee organized meetings for the community and gave us materials. We have had opportunities to study the draft Constitution and make recommendations. Everything was done democratically and publicly."

Democracy was also illustrated in the range of opinions. All people have the rights to express their ideas on major national issues. And people have opportunities to talk publicly in social forums about the political regime, state power, and increasing or reducing the power of the leaders of law enforcement and law making agencies. Deputy Minister of Justice Hoang The Lien is a member of the Steering Committee for Implementation of the 1992 Constitution. "We received recommendations for the preface and 11 sections of the Constitution. The section on human rights received the most comments - over 5 million – followed by the sections on the economic regime, the National Assembly, and the political regime." Lien says.

Nearly 26 million ideas were collected in 3 months.  This shows the people’s interest in and hopes for revising national laws. Phongsak Thiabkaew is Director of Thailand’s Phupan Law Office. "We acknowledge Vietnam’s strong determination to revise the Constitution. We are glad Vietnam has done it in a systematic and scientific manner and made public the revised contents to all people. Vietnam shows respect for human rights. It benefits the Vietnamese people."

Recommendations on the draft Constitution are considered valuable assets. The public is waiting to see how the recommendations will be perceived and elaborated. It’s important to collect opinions accurately and honestly. National Assembly Chairman Nguyen Sinh Hung says: “We’re still studying these comments and discussing them in the National Assembly, the Party’s Central Committee, and the Politburo. We will discuss them in the Drafting Committee for Constitutional Revisions first, then in the National Assembly’s Standing Committee, the National Assembly and then publish them. We will not ignore any comment. It’s important that we collect the wisdom and aspiration of the majority of people”.      

The 3-month referendum on the draft Constitution reveals multiple viewpoints on key national issues, highlights democracy in political campaigns, and reflects the people’s aspirations for the Constitution.
