Vinh Long Court’s notice on divorce case involving Chin Kok Liang, Pham Thi Ngan

(VOVWORLD) - The Vinh Long Provincial People’s Court would like to inform Mr. Chin Kok Liang, born in 1982, whose ID/other identity documents is 820322 - 14 - 6103, of the following ruling.

Mr. Chin Kok Liang’s address is 9 Jalan Cheras Indah 15, Taman Cheras Indah, 56100 Kuala Lumpur, W. Persekutuan (KL), Malaysia.

In the Decree of Divorce No. 57/2024/HNGĐ-ST, dated October 14, 2024, the court’s judgments were stated as followed:

Pursuant to articles 28, 37, 40, 147, 153, 469 and article 477 of the Civil Procedure Code; articles 9, 14, 81, 82, 83 and article 127 of the Law on Marriage and Family 2014; point a, clause 5, article 27 of Resolution No. 326/2016/UBTVQH14, dated December 30, 2016 of the Standing Committee of the National Assembly stipulating the collection, exemption, reduction, collection, payment, management and use of court fees and charges.

1. Accept the lawsuit filed by Ms. Pham Thi Ngan. 

1.1 Marital relationship: Ms. Pham Thi Ngan and Mr. Chin Kok Liang are not recognized as husband and wife.

1.2. Common children: The common children of Ms. Pham Thi Ngan and Mr. Chin Kok Liang - Chin Jia He, born on August 3, 2014 p, and Chin Jia Xuan, born on November 18, 2015 - are entrusted to Ms. Ngan for direct care, upbringing and education.

After divorce, the person who does not directly raise the children has the right and obligation to visit the children without obstruction. If the parent who does not directly raise the children abuses the visitation to hinder or negatively affect the care, upbringing, and education of the children, the person who directly raises them has the right to request the Court to limit that person's right to visit the children. In case of a request from the father, mother, an individual, or an organization, the Court may decide to change the person who directly raises the children or change the level of child support.

1.3 Shared assets and debts: Ms. Pham Thi Ngan declared that they had no shared assets and debts and there was no request for settlement. 

2. Court and judicial entrustment fees:

Ms. Pham Thi Ngan must pay 300,000 (three hundred thousand) VND in civil first-instance court fees and 200,000 (two hundred thousand) VND in overseas judicial entrustment costs. This amount is deducted from the amount of 300,000 (three hundred thousand) VND paid in advance for court fees (receipt No. 0014861 dated December 15, 2023) and the amount of 200,000 (two hundred thousand) VND paid in advance for judicial entrustment costs (receipt No. 014868 dated December 19, 2023) at the Civil Judgment Enforcement Department of Vinh Long province.

Ms. Pham Thi Ngan is refunded 3,000,000 (three million) VND paid in advance for litigation costs (receipt No. 0014867 dated December 19, 2023) at the Civil Judgment Enforcement Department of Vinh Long province.

3.  Ms. Pham Thi Ngan has the right to file an appeal against the Court’s ruling within 15 days after the decision is announced. The duration for Mr. Chin Kok Liang to file an appeal against the Court’s ruling is 12 months after the decree is announced.
