Promoting democracy in building Constitution

(VOVworld) - Five months since it was made available for public comment, the draft of the revised 1992 Constitution was officially discussed on Monday at the 5th session of the 13th National Assembly. Deputies discussed the name of the country, the Party’s leadership, the nature of the economy and economic sectors, human rights and citizen rights.

According to National Assembly deputies, constitutional amendments met people’s aspiration and contributed to solving political, economic and social issues in building a state governed by law, integration and globalization. Deputies stressed the importance of promoting efficiency of the Constitution.

Deputies agreed to keep the country’s name as the Socialist Republic of Vietnam to affirm the country’s determination to develop into a socialist country, and ensure its stability. Some deputies said that the revised 1992 Constitution proves that the State power belongs to the people and that the mechanism of State power is uniform, coordinated and controlled by State apparatus in legislation, law enforcement and jurisdiction. The revised Constitution clearly stipulates function of state agencies.

According to deputies, under the Party leadership, Vietnam has made considerable progress in becoming an independent and free nation developing toward socialism and gaining an increasingly important role in the region and the world. Theoretically and practically, the Communist Party of Vietnam proved its leading role as the only Party that meets people’s aspiration. So, it is important to stipulate the leading role of the Party in Constitution. Nguyen Thai Hoc, a deputy from Phu Yen province, says: “Affirming the Party’s leading role to the State and society in the Constitution is crucial, and objective and in line with the theory about the ruling Party, which has been applied not only in Vietnam but also in several countries, not only with the Communist Party but also other Parties. The Party’s leading role has been proven in reality. The victory of the Vietnamese revolution has always been associated with the Party’s leading role, so it is an objective and equal truth to affirm the Party’s leading role in the Constitution”.

Tran Hong Ha, a deputy from Vinh Phuc province supported the need to stipulate the socialist oriented market economy of Vietnam without mentioning about the role of the State economy to ensure equality between economic sectors. But, Truong Thi Thu Trang, a deputy from Tien Giang province, disagrees: “It is important to clarify the nature of the socialist oriented market economy because the socialist orientation will create prerequisites for overcoming shortcomings of the economy and negative impacts of the process to develop the market economy and integrate into the global economy in Vietnam. So, it is necessary to stipulate that the state economy plays a key role in the development of the socialist oriented market economy in Vietnam  with several types of ownership and economic sectors. This will affirm the nature and boost the development of the economy and at the same time ensure the harmony and balance between economic development and social issues.”

National Assembly deputies agreed that the revised 1992 Constitution clearly stipulate the importance of human rights, fundamental rights and responsibility of citizens as well as the importance of contitutionalizing citizens’ obligations, describing Vietnam’s respect to human rights. According to the Constitution, people obviously enjoy these rights and the State is responsible for accepting, respecting and protecting these rights. In regard to people’s right to mastery, Truong Thi Hue, a deputy from Thai Nguyen province, says:“The Constitution needs to stipulate clearly the mechanism and responsibility of leaders and punishments for violation of people’s rights to mastery. So, I propose to add to Article 2 of the Constitution that all violations of people’s rights to mastery will be seriously punished before law”.

In a frank and democratic atmosphere, National Assembly deputies showed their responsibilities as representatives of voters nationwide contributing to revising the Constitution thus making it more effective.
