Revisions to the 1992 Constitution protect people’s interests

(VOVworld)- The draft of the revised 1992 Constitution has been made available for public comment. New economic, environmental and land-use regulations are the public’s main concerns.

Economic regulations stipulated in the revised 1992 Constitution have received strong support from the public. While the state economy has faced numerous difficulties in recent years, the private and other economic sectors have grown steadily. The revised 1992 Constitution, which stipulates that all economic sectors are equal under the law, will create positive changes for the country as more products, jobs and revenues for the state budget will be generated. Doctor Dinh Dung Sy of the Law Department of the Government Office says these regulations are in line with the Party’s 2011 Platform and documents of the 11th National Party Congress. “The Party’s Platform, socio-economic development guidelines, resolutions and other documents acknowledge the equal participation and development of different economic sectors. The resolution of the 11th National Party’s Congress stresses that the private economic sector is the engine of the economy. In principle, there are neither limitations nor inequality between economic sectors in viewpoints, mechanisms, policies and laws. All economic sectors develop equally in our country’s economic structure”, said Mr. Sy.

Many people have commented that the regulation on common possession of land is in line with the demands of Vietnam’s socialist-oriented market development. The State represents the people’s land ownership, managing and allocating the land in accordance with land distribution regulation. The article on common land possession acknowledges the outcomes of the country’s land revolution in line with the national history of struggle against foreign invaders and defending national sovereignty. The regulation also contributes to maintaining land relationships, avoiding unnecessary problems and ensuring political and social stability, which is an important prerequisite for national development. Le Duyen Ha, Deputy Head of the State and Law Department of Dak Lak Province’s Political School says: ”I think it’s right to stipulate that land belongs to all people and the State represents their ownership. However, common ownership means the land belongs to everybody, so it’s important to stipulate how this right is exercised. For example, the land belongs to all people, so when the state sets prices for or reclaims the land, will the people have the right to have their say as the owners”.

The revised 1992 Constitution aims to raise the responsibility and obligation of individuals and enterprises in protecting the environment. Pham Thi Ha, a pensioner in Yen Bai city says: “The revised Constitution stipulates that people have the right to live in a clean environment and specifies the people’s rights and obligations in environmental protection. These changes in the Constitution are timely and important because the environment is getting more polluted. In compliance with the Constitution, Vietnamese people have to protect the environment”.
