David Camroux, Doctor of Political History of the Sorbonne University of Paris and lecturer at the Sciences Po Paris, said: “China adopted the 1982 UN Convention on the Law of the Sea but has not abided by international law. China does not want to resolve the issues multilaterally but with each single ASEAN country. ASEAN should unite and cooperate to ensure regional peace and stability.”

Monique Chemillier Gendreau, former President of the European Lawyers’ Association, said China has no legal evidence to draw the U-shaped or 9-dash line which is the base for its violations of other countries’ sovereignty. “China said all waters within the U-shaped line is its territory. The argument goes against the 1982 UNCLOS. Countries have the jurisdiction on the waters defined by international law - the territorial waters of 12 nautical miles and the exclusive economic zone within 200 nautical miles from the baseline. If they are talking about historical rights, they must have evidence and other countries’ acceptance. China does not have any legal and historical evidence. Because they can not prove and want to go against the UNCLOS, they have made up their unilateral arguments. ASEAN countries will not accept China’s groundless arguments.”

The experts said the ASEAN Foreign Ministers’ Meeting’s statement on the East Sea showed their awareness of the issue but they should have stronger response and viewpoints.
