The PCA began in-camera hearings on November 24, 2015, with Australia, Indonesia, Japan, Malaysia, Singapore, Thailand and Vietnam allowed to attend as observers.
After reviewing the brief submitted by the Philippines, the tribunal rejected China’s argument that the dispute is beyond the tribunal’s jurisdiction. The PCA said the case reflects a dispute between the Philippines and China concerning the interpretation and enforcement of the UN Convention on the Law of the Sea (UNCLOS), and that this is within the PCA’s scope.
