Tay Ninh Court’s ruling on divorce case involving Low Lai Fatt, Phan Thi Ngoc Han

(VOVWORLD) - The Tay Ninh provincial People’s Court informs Malaysian citizen Low Lai Fatt, born in 1971, about the ruling on the divorce case with Mrs. Phan Thi Ngoc Han.

Mr. Low Lai Fatt’s most recently known address is 14, Kampung Baru, Tanah Mas, 35500 Bidor, Perak, Malaysia.

In the Decree of Divorce (No. 45/2018/HNGD-ST) dated June 25, 2018, the court’s judgements were stated as followed:

Pursuant to Articles 51, 56, and 81 of the Law on Marriage and Family (dated in 2014); Article 27 of the Ordinance on Court Costs and Fees, Article 7 of Circular 02/2016/TTLT/BTP-BNG-TANDTC on the regulations on legal assistance in the civil domain,  Article 228 and Article 477 of Civil Procedure Code;

1. Marital relationship:  It is ordered and decreed by the Court that Mrs. Phan Thi Ngoc Han and Mr. Low Lai Fatt are divorced and that the marriage between them is dissolved.

2. Children: The court accepted Phan Thi Ngoc Han’s request to be the custodian of their child, Low Jie Yi. Mr. Low Lai Fatt is not required to provide financial support for their child.

Phan Thi Ngoc Han and her family are not allowed to prevent Low Lai Fatt from visiting, educating, and taking caring of their child.

3. Shared assets and loans: The Court noted that Mrs. Han requested no settlements for these issues.

4. First instance legal fee: Mrs. Phan Thi Ngoc Han is required to pay the first instance legal fee. The payment was deducted from the court fee advance she made on December 11, 2015 at the Tay Ninh provincial Department of Civil Judgment Enforcement (Receipt No. 0009878). Mrs. Han fully paid the first instance legal fee.

5. Overseas judicial entrustment fee: Mrs. Phan Thi Ngoc Han has to pay the overseas judicial entrustment fee. The full payment was made on May 8, 2017 at the Tay Ninh provincial Department of Civil Judgment Enforcement, receipt No. 0019400.

6. Overseas judicial entrustment cost: Mrs. Phan Thi Ngoc Han does not have to pay the overseas judicial entrustment cost. Three millions VND that Mrs. Phan Thi Ngoc Han made for the overseas judicial entrustment cost advance on July 31, 2017 at the Tay Ninh provincial Department of Civil Judgment Enforcement (Receipt No. 0000309) is refunded to her.

Ms. Phan Thi Ngoc Han has the right to file an appeal against the Court’s ruling at the high-level People’s Court in Ho Chi Minh City within 15 days after the decree is announced. The duration for Mr. Low Lai Fatt to file an appeal against the Court’s ruling is 12 months after the decree is announced.
