The People’s Court of Can Tho City is currently handling a civil dispute concerning a “Commercial Sales Contract” filed by Minh Phu - Hau Giang Seafood Joint Stock Company.

Plaintiff: Minh Phu - Hau Giang Seafood Joint Stock Company

Address: Song Hau Industrial Park – Phase 1, Chau Thanh Commune, Can Tho City, Vietnam (formerly Dong Phu Commune, Chau Thanh District, Hau Giang Province).

The plaintiff requests that H.T. FOODS PVT LTD make the following payments to Minh Phu - Hau Giang Seafood Joint Stock Company:

  • Principal debt: 4,319,925.60 USD (equivalent to 105,794,977,944 VND).
  • Overdue interest for 23 shipments: Calculated up to November 8, 2023, totaling 1,138,649.17 USD (equivalent to 27,885,518,173 VND).
  • Late payment penalties for 13 shipments: 132,009.89 USD (equivalent to 3,232,922,206 VND).
  • Accrued interest: Interest payable in accordance with the Agreement dated February 20, 2019, from the date the judgment becomes legally effective until all obligations are fully discharged.
  • Damages and costs: Compensation for all arising expenses, including the plaintiff’s legal fees.
  • Joint liability: GROUP OF COMPANIES ATLANTIS LLC shall be jointly liable for the aforementioned payments.

Together with the petition, the plaintiff has submitted the following documents and evidence:

  • Enterprise Registration Certificate (copy);
  • Power of Attorney (original);
  • Self-declaration/Statement (original);
  • Agreement Letter dated February 20, 2019 (copy);
  • Vouchers/Receipts and Bills of Lading provide (copies).

Legal requirements for the defendant:

Pursuant to Articles 196 and 199 of the Civil Procedure Code of Vietnam, the defendant is required to submit a written response to the plaintiff’s claims, as well as any counterclaims or independent claims (if any), within 15 days from the date of this notice. Any request for an extension must be submitted in writing, stating valid reasons for the Court’s consideration.
